Member Accounts: When You create an account with Us, You must provide Us with information that is accurate, complete, and current at all times. That means You must use Your real and actual name. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account with Our Products and/or Services.

Purchase of Our Program and Services: We do not accept payment by check, money order, crypto currency, or cash. When You purchase any of Our Products and/or Services are required to make full payment via Stripe, PayPal, or credit card (together “Digital Payment”). When providing Digital Payment information, You represent and warrant that You have the legal right to use the Digital Payment method You provide, and that the information You submit is accurate, complete, and true. We reserve the right to cancel or refuse Member access if Member’s Digital Payment is at any point declined, cancelled or revoked by Member or Member’s Digital Payment vendor, or if Promethean or Our 3rd-party financial services partners suspect Member or Member’s payment is, knowingly or unknowingly, an unauthorized, illegal or fraudulent transaction.

Member Use Only: Member agrees that all Products and/or Services purchased from Promethean shall be for sole and personal use of Member only. Member may not sell, resell, share, give away any or provide access to any Promethean Products and/or Services to any other person. Member may not in any way use Promethean Products and/or Services for business and marketing purposes without the express prior written consent of Promethean or without a signed Affiliate Agreement or Partner Agreement with Promethean.

Members Agree to Receive Communication:

Members in good standing who have paid for access and are past the 3-Day refund window are entitled to lifetime use of any and all Products and/or Services as contracted for and contained as part of Member’s purchase.

2.   No Guarantees: Promethean does not guarantee that Members using Our Products and/or Services will quit smoking successfully, and results may and will vary among Members. Promethean’s Products and/or Services are not, may not be, and will never be a substitute for professional medical advice, diagnosis, prevention, treatment or cure for any health or medical condition.

3.   Use at Your Own Risk: Members acknowledge that participation in the program, including hypnosis, coaching, training, and accessing, using, or interacting with Our Products and/or Services is voluntary and at their own risk. Promethean shall not be liable for any adverse consequences or damages arising from Members use of Our Products and/or Services.

4.   Limitation of Liability: To the fullest extent permitted by law, Promethean, its contractors, 3-rd party service providers, and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to, injury, emotional or psychological distress or anxiety or offense, change in health, inability to work, loss of profits, data, or business opportunities, or any other harm or loss of any kind arising from the use or inability to use Our Products and/or Services.

Hypnosis Disclaimer & Disclosure

All hypnosis recordings in Promethean Programs and Services are designed, created, and/or edited, and produced by Jonathan Wood Logan (“Logan”) for Promethean. Promethean contracts with Logan to provide hypnosis, coaching, consulting, and or other training in Promethean’s Products and Services in accordance with Logan’s acquired education and training.

The following is for disclosure and information purposes only and does not and may not create or imply any legal relationship, professional relationship, warranty, or rights or claims of any kind by Member against Logan individually, personally or as an agent, contractor, owner, licensor, employee or member of Promethean, or against Promethean.

Logan trained in hypnotism at the Northwest Hypnosis Institute, and received Consulting Hypnotherapist Certification from the National Guild of Hypnotists;

Logan received training and certification as a Certified Hypnotherapist and specialized in Conversational Hypnosis from The International Association of Professional Conversational Hypnotists;

Logan is a Certified Member of the National Guild of Hypnotists and I complete annual continuing education to maintain high level training.  The National Guild of Hypnotists is the oldest and largest hypnotism organization in the world and its certification is the most widely recognized credential for the professional practice of the hypnotic arts.

The State of Oregon has not adopted educational and training standards for the practice of hypnotism. This statement of credentials is for informational purposes only.

Hypnotism is a self-regulating profession and its practitioners are not licensed by state governments.  Logan is not a physician or a licensed health care provider. Under Oregon law, Logan may not provide a medical diagnosis nor recommend discontinuance of medically prescribed treatments. Logan’s credentials do not imply state or city licensing or education in any professional medical, health, therapeutic, emotional counseling, psychiatric, psychological or sociological field.

Member rights regarding hypnotism and hypnosis sessions:

1.     If Member desires any kind of help, assistance, support, hypnosis, training, consulting, counseling, coaching, or any kind other of medical or therapeutic treatment or diagnosis from a different program, service, practitioner, etc., Member has the right to and is strongly encouraged to see such at any time;

2.     In the event Member cancels Promethean Products and/or Services before the beginning of Day 4 of the Stop Smoking Forever Program, and provided Member has not accessed any of the program resources beyond Day 3, Member shall have the right to a full and unconditional refund. 3.     Promethean Products and Services include hypnotism sessions. Member has a right to refuse any and all hypnotism sessions and services at any time.

The hypnotism services provided as part of Promethean's Products and Services are held out to the public only as nontherapeutic hypnotism, defined as the use of hypnosis to inculcate positive thinking and the capacity for self-hypnosis.  Promethean does not represent hypnotism elements of Our Products and/or Services as any form of health care or psychotherapy, and despite research to the contrary, by law Promethean may make no health benefit claims for Our Products and/or Services.

Promethean may for any reason, at Promethean's sole discretion, terminate or refer Member a different program, service, hypnotist, therapist, or other appropriate medical or therapeutic professional if Promethean determines or feels Member is not a good fit for Promethean Products and/or Services. In such an event, Promethean will refund Member's purchase price to Member within 30 Days of such determination and communication of same to Member.

The successes of smoking cessation using Promethean's Products and/or Services are dependent on many variables, including attitude, motivation, cooperation, practice and the attendance of scheduled sessions in Promethean Products and/or Services. General & Specific Disclaimers

1.   Nature of Promethean’s Products and/or Services: We employ a combination of techniques that may include hypnotherapy, behavioral counseling, acupuncture, and other holistic approaches similar to those used in chiropractic and psychological therapies. These methods are intended to assist in smoking cessation by addressing both the physical and psychological aspects of nicotine addiction.

2.   Voluntary Participation: Participation in Promethean Products and/or Services is completely voluntary. It is Your responsibility to decide whether Our approach aligns with Your needs and preferences. We request and encourage You to discuss Your participation with a healthcare professional, especially if You have pre-existing health conditions.

3.   No Medical Advice: The Products and/or Services and information provided by Promethean are not a substitute for professional medical advice, diagnosis, or treatment. Our program is not designed or intended to diagnose, treat, or cure any medical or psychological conditions. We do not offer medical advice, and Our staff is not qualified to nor will they provide such advice. Always seek the guidance of Your physician or other qualified health providers regarding any medical condition or treatment.

4.   No Guarantees of Effectiveness: While many individuals have benefited from methods We use or similar to those used in Our Products and/or Services, Promethean not guarantee success in smoking cessation. Individual results vary significantly based on personal commitment, health factors, adherence to the program and other factors out of the control of Promethean. We do not and cannot claim that Our Products and/or Services will lead to a certain outcome or result.

5.   Potential Risks: As with any process, program, advice, tools, services, training, therapy, or treatment, it is possible that there are potential and/or unknown and/or reasonably unanticipated or unforeseen risks and/or side effects associated with the methods used in Our program. These may include emotional distress, physical discomfort, or other reactions. While these instances are very rare and every effort is made to ensure a safe environment, it is important to understand and accept these risks before participating. Members accept all potential risks associated with and/or stemming from use of, association with, or exposure to any and all of the tools, practices, exercises, systems, procedures, advice, programs, et alia, in, with or arising from Promethean’s Products and/or Services.

6.   Confidentiality: We respect Your privacy and confidentiality. Any personal information You share with Us will be kept confidential in accordance with applicable laws and professional standards. However, there may be circumstances under which we are legally obligated to disclose information (e.g., in cases of a threat to Yourself or others).

7.   Limitations of Online/Remote Services: If Promethean offers Products and/or Services through online or remote platforms, please be aware that these methods have inherent limitations compared to in-person sessions. Technical issues, privacy concerns, and the effectiveness of remote communication and transmission can affect the delivery, quality and outcome of Our Products and/or Services. Promethean shall not be liable or responsible for temporary or intermittent disruption or quality issues caused or as a result of the actions or inactions of 3rd party vendors; such as Your or Our internet service providers, telecommunication providers, hosting services, platform services, email services, and/or like or related or dependent technology products or services.

8.   Complementary Approach: Our program is intended to be a complementary approach to smoking cessation. It is designed to be part of a broader health and wellness plan that may include medical treatment, psychological therapy, and lifestyle changes. We encourage communication and collaboration with Your healthcare providers prior to engaging with or starting Promethean’s Products and/or Services to ensure an optimal and personalized holistic approach to Your health.

9.   Changes to Services: Promethean reserves the right to modify, update, improve, condense, add to, delete from or discontinue any Products and/or Services or aspects of Our Products and/or Services at any time without prior notice. Unannounced changes may also be made to improve the quality and effectiveness of the program or to comply with regulatory or legal requirements.

10.      Participant Responsibility: Your progress and success with Promethean’s Products and/or Services depends almost entirely on Your active participation, follow through, and commitment. It is Your responsibility to attend to and complete all elements of Promethean’s Products and/or Services; including attending sessions, following all program guidelines, completing all exercises and trainings, properly learning and adopting all tools and techniques, and communicate openly with Our staff if You have any questions. Your feedback is essential in improving, tailoring, and refining Our approach and Products and/or Services in response to Our customer’s needs.

11.      Indemnification: By participating in Promethean’s Products and/or Services You agree to indemnify and hold harmless Promethean, its staff, and affiliates from any claims, liabilities, losses, damages, or expenses, including legal fees, arising from Your participation in the program.

12.      Acknowledgment and Consent: By continuing with Promethean’s Products and/or Services, You acknowledge that You have read, understood, and agree to this disclaimer. For example, if You provide a written or audio testimonial saying that You were a former smoker with lung cancer and You used Our Products and/or Services to stop smoking then only the information You provided with the specific intent and disclosure would be used by Us and then only for the specific and agreed upon purposes.

If You make a digital payment through Our website, Your payment-related information is not stored by Us but is collected by Our third-party payment processors who specialize in secure processing of credit/debit card transactions.
